These Terms and Conditions create a legally binding agreement between you and Club Track (which we may refer to as \u201cClub Track,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d) regarding orders placed for products available on&nbsp;<a href=\"http:\/\/clubtrack.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">clubtrack.org<\/a>. Club Track may revise these Terms and Conditions without notice by posting revised Terms and Conditions on its website. The Terms and Conditions posted on&nbsp;<a href=\"https:\/\/clubtrack.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">clubtrack.org<\/a>&nbsp;at the time your payment will govern that transaction.&nbsp; Please read these terms carefully and check that the details of your order are complete and accurate before submitting your payment. Otherwise, you may specify to a different directive for your donation by emailing us at <a href=\"mailto:coach@clubtrack.org\">coach@clubtrack.org<\/a>&nbsp;or calling us at (215) 385-5166.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Donation can be made by credit\/debit card card through PayPal or by a PayPal account.<br>Your transaction will be processed securely through PayPal. Your payment details won't be shared with any other third party.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"91\">Unauthorized card use<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider. If you suspect fraudulent use of your PayPal account, you must file a claim through PayPal.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"92\">Information from you<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">The information you provide when making your donation will never be shared with anyone. Considering this, before we can process your donation we require (i) a first name, and (ii) an email address for us to send your receipt. It is your responsibility to ensure you have provided us with the correct information. PayPal will require details of the credit\/debit card that you wish to use to use, or your account login information.<br>When you submit your payment details, your data will be collected and processed securely by PayPal.<br>We won\u2019t share your personal details with any other third party.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"93\">Refund policy<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">If you make an error in your donation please contact us either by email&nbsp;<a href=\"mailto:coach@clubtrack.org\">coach@clubtrack.org<\/a>, or by phone at (215) 385-5166. If you contact us or or your mail is postmarked within 14 days of submitting your donation, you will receive a full refund.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"94\">General<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">The Donation Terms and Conditions posted on&nbsp;<a href=\"https:\/\/clubtrack.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">clubtrack.org<\/a>&nbsp;at the time your payment will govern that transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We reserve the right to amend our donations agreement by changing our Donation Terms and Conditions, although any changes made after your donation is processed will not affect that transaction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"32\"><strong>Placing orders on&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/clubtrack.org\/\" target=\"_blank\">clubtrack.org<\/a><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Eligibility To Order<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To place an order on&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/clubtrack.org\/\" target=\"_blank\">clubtrack.org<\/a>, you must be of legal age in your country and a consumer \u2013 not a reseller.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No Purchase For Resale<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Products for sale on&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/clubtrack.org\/\" target=\"_blank\">C<\/a><a rel=\"noreferrer noopener\" href=\"https:\/\/clubtrack.org\/\" target=\"_blank\">lubtrack.org<\/a>&nbsp;are intended solely for Club Track to sell to our direct end consumers, and therefore purchase of products for resale is strictly prohibited. Purchase for resale means the purchase of a Club Track&nbsp;product by someone who resells, or intends to resell, the Club Track product to others (consumers, businesses or any third party).&nbsp; If Club Track believes you are involved in purchase for resale, Club Track reserves the right to take any action against you, including, without limitation, to restrict sales to you, cancel your orders, and\/or suspend or close your account. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How To Order<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You need an e-mail address to place an order, and you may need to set your browser to accept both (functional) cookies and pop-ups in order to be able to use all the functionalities of the Website, which includes designing customized items, adding items to your shopping bag and submitting your order.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you submit an order we will send you an email acknowledging receipt of your order.&nbsp; Our acceptance of the order takes place when the Products are shipped to you \u2013 we will send you an email confirming that the Products have been shipped (\u201cOrder Confirmation\u201d). At this point a contract, containing these Terms and Conditions, comes into existence and is binding on you and us (the \u201cContract\u201d). We recommend that you print or download a copy of these Terms and Conditions and the relevant Order Confirmation for future reference.&nbsp; If we are unable to supply you with a product, we will inform you of this in writing and will not process the order.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Our Right To Reject Your Order Or Cancel A Contract<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fulfillment of all orders on&nbsp;<a href=\"http:\/\/clubtrack.org\/\">clubtrack.org<\/a>&nbsp;are subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel a Contract by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the Contract we cancelled:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the product is not available \/ in stock;<\/li><li>your billing information is not correct or not verifiable;<\/li><li>your order is flagged up by our security systems as an unusual order or an order susceptible to fraud;<\/li><li>your bank transfer payment is not received within 12 calendar days after acceptance of your order;<\/li><li>we believe you are under the legal age in your country;<\/li><li>we believe that you are a reseller;<\/li><li>there was an error in the price displayed on&nbsp;<a href=\"http:\/\/clubtrack.org\/\">clubtrack.org<\/a>;<\/li><li>we could not deliver to the address provided by you;<\/li><li>due to a processing error with our manufacturer or payment platform;<\/li><li>due to events outside of our control (see Events Outside of Our Control section below)<\/li><li>in the event of misspelling, pricing or other errors or mistakes in the product description information.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Title Transfer &amp; Risk of Loss<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With the exception of products purchased offline, the title and risk of loss for any product(s) purchased from Club Track pass to you upon our delivery to the carrier.&nbsp; Title and risk of loss for any product(s) will not transfer until your full payment has been received and your authorized purchase receipt has been issued.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Events Outside Our Control<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms and Conditions:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a)&nbsp;&nbsp;&nbsp;&nbsp; We will contact you as soon as reasonably possible to notify you; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b)&nbsp;&nbsp;&nbsp;&nbsp; Our obligations under these general conditions will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the Event Outside Our Control affects Our delivery of a product to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.&nbsp; You may cancel the contract if an Event Outside Our Control takes place and you no longer wish us to provide the products. We only process payments through PayPal, Braintree, or Amazon. We cannot accept any other payment methods at this time. Please do not try to pay by any other way than specified there. If you do, we will not be liable for loss of the payment or any other damages that may result from this action.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Payment Processing<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For non-stock items, we start creating the products you order on&nbsp;<a href=\"http:\/\/clubtrack.org\/\">clubtrack.org<\/a>&nbsp;as soon as you receive your order confirmation&nbsp;email. If you pay by credit\/debit card through either PayPal, Braintree, or Amazon, the cost of your purchase will be deducted from your account as soon as your order is processed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Canceling Orders Place By Mistake<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you placed an order by mistake, please contact&nbsp;<a href=\"mailto:coach@clubtrack.org\" target=\"_blank\" rel=\"noreferrer noopener\">coach@clubtrack.org<\/a>&nbsp;immediately to request a cancelation and payment refund of the amount deducted during purchase. We will request that our manufacturer ceases production, although since many of our products are made nearly right away, we can not guarantee that your order will be canceled and refunded.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Prices and Currency<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The product prices displayed on&nbsp;<a href=\"http:\/\/clubtrack.org\/\">clubtrack.org<\/a>&nbsp;are inclusive of Value-Added Tax (VAT), as applicable. Standard Shipping rates within the USA are also included in the product prices. For orders being sent outside the USA shipping rates are applied per order. The exact shipping rates depend on the country where your order is being delivered to. For details on shipping rates per country see the Shipping Information section below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are quoted in local currency. If you change the country of delivery while browsing or during check out, prices from that moment may be quoted in a different currency. Please note that changing the country of delivery may have an influence on the price due to a change in currency or to country specific pricing.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Your Total Price<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The total price specified in the final check out screen includes tax and shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. We can only fulfill an order to a delivery address which is a home or office address in one of the countries serviced by our sales platform.&nbsp;All orders are processed&nbsp;<strong>24 hours<\/strong>&nbsp;after your payment is made. All purchased items are carefully made by our highly skilled workers, but most of the time your products are completed and ready for shipment within 2-3 days.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery.
